Amendment for the Plastic Waste Management Rules Amended (2023)

OVERVIEW

Important update regarding amendment applicable to all existing Licence holders/ New applicants/ manufacturers/ importers/ product sellers for the Amendment for the Plastic Waste Management Rules Amended (2023).

1. The amendment is called the "Plastic Waste Management (Second Amendment) Rules, 2023."
2. These amended rules come into force from the date of their publication in the Official Gazette.
3. Sub-rule (1) of rule 9 will not apply to export-oriented units or units in special economic zones, with exceptions for pre-consumer plastic packaging waste.
4. Definitions have been updated, including the definition of "carry bags" and "producer."
5. The term "multi-layered packaging" has been replaced with "plastic packaging" in various sections.
6. "Urban local bodies" has been changed to "local bodies" in rule 5.
7. Rule 11 now mandates specific information on plastic packaging, with various dates for compliance, depending on the type of packaging.
8. Amendments have been made in rule 12 regarding the authority responsible for enforcing these rules.
9. Rule 13 outlines the registration process for producers, importers, and recyclers of plastic waste.
10. Rule 16 establishes a State Level Monitoring Committee for effective rule implementation.
11. Several updates to Schedule II, including a change in the deadline for filing annual returns and provisions for the purchase of extended producer responsibility certificates.

These amendments aim to strengthen plastic waste management in India, promote environmental responsibility, and improve compliance with the Plastic Waste Management Rules.
