Important update regarding Indian Standard applicable to all existing Licence holders/ New applicants/ manufacturers/ importers/ product sellers for the Flame-Producing Lighters (Lighters – Safety Specification) (Quality Control) Order, 2023.

OVERVIEW

The Ministry of Commerce and Industry has released the Flame- Producing Lighters (Quality Control) Order, 2023, effective six months from the notification date, with distinct compliance timelines for Small and Micro Enterprises as defined in the Micro, Small, and Medium Enterprises Development Act, 2006 (27 of 2006). Small Enterprises are required to comply within nine months, while Micro Enterprises have a twelve-month timeframe from the date of publication.

Goods or articles falling under Flame-Producing Lighters must meet the standards outlined in Indian Standard IS/ISO 9994:2018 (Lighters – Safety Specification) and display the Standard Mark, obtained through a license from the Bureau under Scheme-I of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.

Exceptions to this order include goods manufactured domestically for export and those produced by enterprises registered under the "Udyam portal" of the Ministry of Micro, Small, and Medium Enterprises.

Exempted enterprises have an investment in plant and machinery or equipment not exceeding twenty-five lakhs rupees, and a turnover not exceeding two crores rupees for the previous financial year, as certified by a Chartered Accountant.

The Bureau is designated as the certifying and enforcing authority for Flame-Producing Lighters, and any violation of this order is subject to punishment under the provisions of the Bureau of Indian Standards Act, 2016.
