Important Update regarding the regulation called the Environment (Protection) 115 Amendment Rules, 2021 Bureau of Indian Standards (BIS) has developed an IS standard (IS 16240: 2015) for Reverse Osmosis (RO) based Point of Use (PoU) Water Treatment System and providing Type approval for RO based Water Purifier, requirements applicable to manufacture/import/sale in an Indian market. No Domestic Water Purification System shall be manufactured, imported or assembled without the ISI Standard Mark and BIS Certification IS 16240:2015.

Notification of Environment (Protection) 115 Amendment Rules, 2021 for appropriate use of Reverse Osmosis (RO) Based Point of Use (PoU) Water Treatment System [IS 16240:2015]

Overview

The Gazette Notification dated 4th October, 2021 The Ministry of Environment, Forest and Climate Change (MoEF&CC) to come out with Regulation on Appropriate “Use of Reverse Osmosis (RO) Based Point of Use (PoU) Water Treatment System”.

The Government of India and the Ministry of Environment, Forest and Climate Change in India have come up with the latest amendments and regulations on Reverse Osmosis (RO) Based Point of Use (PoU) Water Treatment System and are regulated as per the document, along with the implementation date and respective Indian standard.

As a result, the Central Government hereby establishes the following rules to amend the Environment (Protection) Act, 1986 (29 of 1986), in exercise of the powers provided by sections 6 and 25 of the Environment (Protection) Act, 1986 (29 of 1986):

(1) These rules may be called the Environment (Protection) 115 Amendment Rules, 2021.

(2) Except as otherwise stated in these regulations, they take effect after an eighteen-month period from the date of publication in the Official Gazette.

2. After serial number 114 and the entries relating to it in Schedule I of the Environment (Protection) Rules, 1986, the 115 Regulation mentioned in the attached notification shall be inserted.

All manufactured, produced, imported or assembled Domestic Water Purification System (DWPS) shall bear the IS Standard Mark under a Licence from the Bureau of Indian Standards (BIS) as per the Indian Standard ISI 16240 under Scheme – I, Schedule – II of BIS and discarded DWPS elements must be treated in accordance with the Plastic Waste Management Rules, 2016. As per sub-clause (i) of the clause of paragraph 2, BIS CERTIFICATION is mandatory for manufacturers of DWPS. The user of “Other than Domestic Water Purification System” shall apply for authorisation before 4th April, 2022 for the grant of Registration as per the provisions of rules made under Environment (Protection) Act, 1986.

In case there is any difficulty or dispute in the implementation of all mentioned provisions, the matter will be referred to the nodal agency. The nodal agency will establish a Standing Committee to address process integrity and recovery efficiency evaluation issues, as well as to provide advice on all topics relating to the implementation of these regulations, including the resolution of any disputes."

Implementation Dates: As per the notifications, come into force on the expiry of a period of eighteen months from the date of their publication in the Official Gazette.
